TERMS OF USE FOR TERATANY.ORG

Welcome to Teratany.org, a social network dedicated to people interested in Sustainable Development Goals (SDGs) and Corporate Social Responsibility (CSR).

These Terms of Use (hereinafter "TOU") constitute a legally binding agreement between you (hereinafter "User", "you" or "your") and Teratany.org (hereinafter "Teratany", "we" or "our"), governing your access and use of the Teratany.org platform, including all features, applications, data, services, content, and tools offered therein (hereinafter the "Platform").

By registering on the Platform or using it in any way, you acknowledge that you have read, understood, and agreed to be bound by these TOU. If you do not accept these terms, please do not use the Platform.

2.1 Age Requirements

The use of the Platform is strictly prohibited for persons under the age of 14. By creating an account, you certify that you are at least 14 years old.

2.2 Account Creation

To use the Platform, you must create an account by providing accurate, complete, and up-to-date information. You are fully responsible for maintaining the confidentiality of your password and for all activities that occur under your account.

2.3 Account Types

The Platform offers three types of accounts:

• Individual user account
• Business account
• Association account

Business and association accounts are visibly differentiated from individual accounts by specific visual markers. A user can create sub-accounts linked to their main account, but only as a business or association. Business and association accounts cannot create or administer other business or association sub-accounts.

3.1 Platform Features

Teratany.org offers several features, including:

• A Discord-style chat for communicating with other users
• An Instagram-like publication system
• A mapping system to locate users (according to their privacy preferences)
• A news feed gathering all user publications
• A personalized news feed displaying only publications from followed users
• The ability to link SDG and CSR interests to your profile and publications

3.2 User Content

You are solely responsible for the content you post, upload, share, or transmit on the Platform (hereinafter "User Content"). By posting User Content on the Platform, you warrant that:

• You own this content or you have the necessary rights to share it
• This content does not violate the rights of any third party, including intellectual property rights
• This content is not illegal, defamatory, obscene, offensive, discriminatory, or otherwise inappropriate

3.3 License on User Content

While retaining all your rights to your User Content, you grant Teratany a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, distribute, prepare derivative works, display, and perform your User Content in connection with the operation and provision of the Platform.

This license ends when you delete your User Content or your account, except if your content has been shared with other users and they have not deleted it.

3.4 Prohibited Behaviors

The following behaviors are strictly prohibited on the Platform:

• Violating applicable laws
• Impersonating another person
• Harassing, intimidating, or threatening other users
• Posting illegal, offensive, defamatory, pornographic, or violent content
• Using the Platform for spam or unsolicited advertising
• Attempting to access restricted parts of the Platform without authorization
• Interfering with the operation of the Platform or overloading its infrastructure
• Collecting information about other users without their consent

4.1 Data Collection and Use

Teratany collects and processes your personal data in accordance with its Privacy Policy. By using the Platform, you consent to this collection and processing.

4.2 Location and Geographic Data

When you connect, your IP address will be collected and used to determine your country of origin. The Platform allows you to manually select your geographic location. By default, your location is set as private and will not appear on the map. You can change this setting in your privacy preferences.

4.3 Private Data

The following information can be set as private in your privacy settings:

• Address
• Geographic location
• Country

When this information is set as private, it is stored in our database but is not publicly displayed.

4.4 Non-Sharing Commitment

All user data is retained by Teratany and will never be shared with third parties or sold.

4.5 Cookies

Teratany does not use cookies to store information on your device.

5.1 Termination by the User

You can delete your account at any time via your account settings. Before deletion, you have the option to download your data.

5.2 Termination by Teratany

We reserve the right to suspend or terminate your account, remove your User Content, and limit your use of all or part of the Platform, without notice or liability, for any reason, including, without limitation, if we believe you have violated these TOU.

5.3 Consequences of Termination

Upon termination of your account, your profile and User Content will no longer be accessible on the Platform. We may retain certain information in accordance with our legal obligations or legitimate interests.

6.1 Content Reporting

You can report any inappropriate content or violation of these TOU by using the reporting function available on the Platform or by contacting us by email.

6.2 Moderation Procedure

We will review reports and take appropriate action, which may include removing content or suspending the responsible account.

7.1 Teratany Rights

The Platform, including its source code, design, logos, trademarks, and other distinctive elements, is the exclusive property of Teratany and is protected by intellectual property laws.

7.2 Limited Use

The use of the Platform does not grant you any intellectual property rights to the Platform or to any content you access, except for your own User Content.

8.1 Platform Availability

We strive to keep the Platform accessible at all times, but we do not guarantee that the Platform will be available without interruption or error.

8.2 Disclaimer of Warranty

The Platform is provided "as is" and "as available," without warranty of any kind, express or implied.

8.3 Limitation of Liability

To the fullest extent permitted by applicable law, Teratany will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

We reserve the right to modify these TOU at any time. Modifications will take effect immediately upon their publication on the Platform. Your continued use of the Platform after the publication of the modified TOU means that you accept these modifications.

10.1 Applicable Law

These TOU are governed by the laws of Madagascar.

10.2 Dispute Resolution

Any dispute arising from or related to these TOU will be submitted to the exclusive jurisdiction of the courts of Madagascar.

10.3 Severability

If any provision of these TOU is deemed unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the other provisions of the TOU will remain in full force and effect.

10.4 Entire Agreement

These TOU constitute the entire agreement between you and Teratany regarding your use of the Platform.
